There are different types of Custody to fight for. Knowing which to pursue and how to get them is important while litigating for your child. 

Types of Custody  

LEGAL CUSTODY

Legal custody refers to the right to make decisions about the child's life, including education, medical management and activities.

PHYSICAL CUSTODY

Physical custody refers to the time that the child spends with each parent.

How can these be awarded?

JOINT CUSTODY 

New Mexico law assumes that “joint" custody is the best interest of the child(ren).  Joint custody means that both parents make legal decisions (ie. school, doctor, dentist, activities in which the child participates) and spend time with the children.  Joint custody DOES NOT necessarily mean equal time which each parent. Equal time-sharing is possible in joint custody but not guaranteed. ​

SOLE CUSTODY

Sole Custody is rarely awarded without a reason that ​impacts the best interest or safety of the child(ren). Some circumstances that would warrant such an extreme decision is if one parent is struggling with addiction that can put the child(ren) in danger.
