Divorce is a stressful time even when parties are in agreement. It is better to have a lawyer with you from the beginning of your divorce and not just when things go wrong. New Mexico is a community property state that has it's own rules and principles. Having an attorney with you can help you ensure that you are protecting your assets and getting what you are entitled to from your marriage. Our attorneys can help you with the following in a divorce:

  • Fairly diving marital assets
  • Protecting and dividing financial accounts, investments, retirement accounts, and debt
  • Fighting for and against spousal support
  • Ensuring that large sums of money have not gone "missing" and property is not all the sudden under different ownership
  • Ensuring property is fairly divided and re-deeded appropriately
  • Deciding who will the family pets
  • Everything having to do with any children *See Family Law Section

Domestic Violence

Domestic Violence, more times than not, ends up with one party being arrested. This results in criminal charges and arrest records. Depending on the facts of your case this could result in a misdemeanor or a felony charge.  A conviction of Domestic Violence can affect your employment, ability to own weapons, your housing, potentially your right to vote, and custody of your child(ren).  Our lawyers can help you with:

  • Domestic violence criminal charges (misdemeanors of felonies)
  • Domestic violence Restraining Orders **These move fast so please call as soon as possible
  • Custody after domestic violence allegations

Estate Planning

No one likes to talk about happens when they pass or if there were to become ill, however, the best way to protect your family and loved ones is to have a plan that details your wishes. Your loved ones shouldn't have to guess what you would want in this time of extreme stress and grief.  A great estate plan will:

  • include instructions for your care and financial affairs if you become incapacitated
  • include wishes for the transfer of your business at your retirement, disability, incapacity, or death
  • name a guardian for your minor children’s care and inheritance
  • provide for family members with special needs without disqualifying them from government benefits
  • provide for loved ones who might be irresponsible with money or who may need protection from creditors
  • minimize taxes, court costs, and unnecessary legal fees, which may include funding assets into a living trust, completing or updating beneficiary designations, or otherwise aligning your assets with your estate plan

Mediation

Mediation can be an effective way to resolve outstanding issues between parties. Maybe you agree on 99% of your divorce and just need guidance on those final details. Whatever might be keeping you from resolution can often times be resolved with an experienced and legally trained mediator. Our attorneys can, and have, facilitated successful mediations here in New Mexico ranging from the division of property and assets to complex custody issues.

Guardian Ad Litems

A guardian ad litem, aka GALs, is an attorney that is appointed by the court to represent the best interest of the child in question. These attorneys review the child's current living situation and relationship with all parents/caretakers and makes recommendations to the Court on custody, time-sharing, medical treatment, whether or not a child should be allowed to relocate with one of the parents, and so much more.  GALs can be appointed in cases involving divorce, custody, and guardianships.
