PHYSICAL CUSTODYPhysical custody refers to the time that the child spends with each parent.

JOINT CUSTODYNew Mexico law assumes that “joint" custody is the best interest of the child(ren). Joint custody means that both parents make legal decisions (ie. school, doctor, dentist, activities in which the child participates) and spend time with the children. Joint custody DOES NOT necessarily mean equal time which each parent. Equal time-sharing is possible in joint custody but not guaranteed.

SOLE CUSTODYSole Custody is rarely awarded without a reason that impacts the best interest or safety of the child(ren). Some circumstances that would warrant such an extreme decision is if one parent is struggling with addiction that can put the child(ren) in danger.
